of Illinois: Expungement, Seal, and Pardon from the
Board of Pardons and Parole |

Illinois
Expungement: The process of legally
destroying, obliterating or striking out records or
information in files, computers and other
depositories relating to criminal charges. The
records cannot be accessed for general law
enforcement or civil use.
An expunged record may
not be considered by any private or public entity in
employment matters, certification, licensing,
revocation of certification or licensure, or
registration. 20 ILCS 2630/12
In Illinois, criminal
records may only be expunged under the following
circumstances:

1. A
person reaching age 17 may have prior records may be expunged if:
no petition for delinquency filed, or
found not delinquent of offense, or
offense would be Class B misdemeanor if an adult, or
order of supervision terminated.
705 ILCS 405/5-915
2. At any
time after turning 21 or having 5 years pass since last juvenile court
proceeding or confinement terminated, whichever is first, and no convictions
since 17th birthday, a person may apply for expungement of delinquency offense
committed before age 17 not resulting in criminal court proceedings. Expungement
is not available for first-degree murder or sex offenses.

3. Whenever any person has reached the age of 17 or whenever all juvenile
court proceedings relating to that person have been terminated, whichever is
later, the person may petition the court to expunge law enforcement records
relating to incidents occurring before his 17th birthday or his juvenile court
records, or both, if the minor was placed under supervision pursuant to Sections
2-20, 3-21, or 4-18, and that order of supervision has since been successfully
terminated. 705 ILCS 405/1-9
4. A
person whose conviction has been set aside on direct review or on collateral
attack and the court determines by clear and convincing evidence that the
defendant was factually innocent of the charge.

5. Your record can be expunged of municipal ordinance, misdemeanor and felony
charges IF:
You were found NOT GUILTY of the charges, OR
The State dismissed the charges against you.
6. If you were sentenced to
supervision for certain misdemeanors, AND
It has been at least five years since supervision was discharged, AND
You have not been arrested or criminally charged since the supervision was
discharged.
7. Class 3 and Class 4 Felony Drug Convictions.

8. An adult or minor prosecuted as an adult, not having
previously been convicted of any criminal offense or municipal ordinance
violation, charged with a violation of a municipal ordinance, misdemeanor, or
felony, is acquitted or released without being convicted.

9.
PARDON: A person who has been convicted of an offense
is granted a pardon by the Board of Pardons which specifically authorizes
expungement. 20 ILCS 2630/5
A pardon may be granted to those individuals who have maintained a good
reputation in their community, following the completion of their sentence for a
criminal offense.
After a pardon, a court ordered expungement may be granted.

Illinois Pardon: A
Pardon is a constitutionally authorized process that
provides the means through which convicted felons
may seek restoration of their civil rights and may
be considered for relief from punishment. The
restoration of voting rights and other civil rights,
pardons, commutation of sentence, relief from fines
and forfeitures, and restoration of firearm
authority will be granted.

Expungement is a process,
not an
event. Even after your expungement is
granted, it is useless until
government and privately owned criminal
databases are updated!
In most cases, criminal databases
have 180 days to remove your name from their
database if a pardon, expungement, seal, or
non-disclosure is granted.

Remember, conviction records don't
automatically go away with the passage of
time. People, even with minor conviction,
have to take actions in order to expunge
their records. In addition,
expungement orders from any state aren't
worth the paper they are written on if
government and privately owned criminal
databases aren't updated.

takes from 3 to 6 months (and sometimes
longer) depending upon the Court, the
complexity of the case, and how old the
conviction is.
