criminal record was created in your name. Many people believe
that if their case was dismissed or were never convicted they do
not have a criminal record. Unfortunately this is not the
case!
You can find just about anything
you want on the internet today; if you have an arrest record or
criminal history (even misdemeanors) anyone can access this
information!
In some cases you can be denied employment,
housing, credit, and many other social services because of your
record.

State
of Florida: Expungement, Seal, and Pardon from the
Board of Pardons and Parole |

Florida
Expungement: Any criminal history record that
is ordered to be expunged by a court of competent
jurisdiction must be physically destroyed or
obliterated by any criminal justice agency having
custody of such record. In Florida, criminal
records may only be expunged under the following
circumstances:
1. An indictment,
information, or other charging document was not
filed or issued in the case (not prosecuted, or no
bill).
2. An indictment, information, or
other charging document, if filed or issued in the
case, was dismissed or nolle prosequi by the state
attorney or statewide prosecutor, or was dismissed
by the court. Sec.
943.0585
3. The non-judicial
record of the arrest of a minor who has
successfully completed a pre-arrest or post-arrest
diversion program may be expunged. Sec.
943.0582
4. The court may only
order expunction of a criminal history
record pertaining to one arrest or one incident of
alleged criminal activity, unless additional arrests
directly relate to the original arrest and the court
specifies its intent to expunge additional arrest
charges in the order. Sec.
943.0585 5
A Misdemeanor
conviction may be sealed if it is not on the
disqualifying list as provided by Florida Statues
Title XLVII, Criminal Procedure and Corrections:

Sexual Battery;
Lewd, lascivious, or indecent assault or act
upon or in presence of a child under the age
of 16 years, or Sexual activity with a
child, who is 12 years of age or older but
less than 18 years of age, by or at
solicitation of person in familial or
custodial authority, or Lewd or lascivious
offenses committed upon or in the presence
of an elderly person or disabled person;
Offenses by public officers and employees;
Computer pornography;
Selling or buying of minors;
Drug trafficking;
Arson;
Aggravated assault, Aggravated battery,
Stalking, or Aggravated stalking;
Illegal use of explosives;
Kidnapping, Child abuse, aggravated child
abuse, or abuse of an elderly person or
disabled adult, or Aggravated abuse of an
elderly person or disabled adult;
Aircraft piracy;
Homicide, or Manslaughter;
Robbery, Burglary of a dwelling, or Home
invasion robbery;
Carjacking;
Act of domestic violence as defined in s.
741.28;
Act of terrorism against the State of
Florida as defined in s.
775.30;
Attempting or conspiring to commit
any of the crimes listed above.

6. Adjudication was withheld by the court, OR
the adult has successfully completed a diversion
program.
Sec. 943.0585
Any court fines must have been paid;
Any court ordered restitution must have been
paid; |
7. Pardon: If you do NOT meet the requirements
listed above a pardon from the Florida Board of
Pardons would be required.
Florida Pardon:
A
Pardon is a constitutionally authorized process that
provides the means through which convicted felons
may seek restoration of their civil rights and may
be considered for relief from punishment. The
restoration of voting rights and other civil rights,
pardons, commutation of sentence, relief from fines
and forfeitures, and restoration of firearm
authority will be granted. |

Expungement is a process,
not an
event. Even after your expungement is
granted, it is useless until
government and privately owned criminal
databases are updated!
In most cases, criminal databases
have 180 days to remove your name from their
database if a pardon, expungement, seal, or
non-disclosure is granted.

Remember, conviction records don't
automatically go away with the passage of
time. People, even with minor conviction,
have to take actions in order to expunge
their records. In addition,
expungement orders from any state aren't
worth the paper they are written on if
government and privately owned criminal
databases aren't updated.

speedy as possible. The procedure typically
takes from 3 to 6 months (and sometimes
longer) depending upon the Court, the
complexity of the case, and how old the
conviction is.
